REPRESENTATIVE ENGAGEMENTS
- CB&H Business Services, LLC v. J.T. Comer Consulting, Inc. and CBH Pensions, Inc., 646 S.E.2d 843 (N.C. App. 2007), aff’d per curiam, 653 S.E.2d 145 (NC 2008). Successfully represented client through an appeal of a breach of asset purchase agreement.
- Seven Seventeen HB Charlotte Corp. d/b/a Adam’s Mark Hotel, Charlotte v. Shrine Bowl of the Carolinas, Inc., et al., 641 S.E.2d 711 (N.C. App. 2007). Co-counsel in winning summary judgment and appeal in a breach of contract action. The North Carolina Court of Appeals held that the case was a matter of first impression on the issue of which party has the burden on a defense of invalid liquidated damages.
- Matthew Howard York, Incompetent, by and through his General Guardian, Shirley C. York v. David Gordon Smith and BB&T Investment Services, Inc., NASD-DR Arbitration Case No. 06-03094. Successfully represented clients against claims of breach of fiduciary duty, constructive fraud, breach of contract, negligence, negligent misrepresentation, failure to supervise, and violations of NASD and NYSE rules.
- L. J. Whitmire and Susan S. Whitmire v. BB&T Investment Services, Inc.,
NASD-DR Arbitration Case No. 04-05199. Successfully represented clients against claims of failure to supervise, suitability, violation of the Securities Exchange Act, and respondeat superior.
- Merrill Anne Carlson v. Merrill Lynch, Steven Hill, David Vaughan, Milton Bates; NASD-DR Arbitration Case Number 00-04804. Successfully represented clients against claims of suitability and breach of fiduciary duty.
